Kajwang’ cleared, House committee calls for cohesion at Immigration ministry

The Parliamentary Committee on Administration, National Security and Local Authorities, however, called for redeployment of Director of Immigration Services Joseph Ndathi to allow independent investigation.

Ndathi is accused of highhandedness in giving permits and the committee recommends that the director should focus on overall administration of the department.

"The current director has ostensibly focused on issuance of permits at the expense of other sections of the department which are equally important," says the report.

Poor workmanship

Poor work relationship between Ndathi and Kajwang’, as well as that of former minister Gideon Konchellah, the committee heard, had affected service delivery.

The report shows Ndathi was to be transferred after friction with Konchellah, but alleged connections salvaged him.

It indicted the ministry of alleged corruption but suggested change of staff at the Immigration Department.

Kajwang’ had been accused of going against the advice of technocrats in the issuance of permits to missionaries of Church of Jesus Christ of the Latter Day Saints and other foreigners.

The committee’s 17-page report says Kajwang’ acted within the law and was, therefore, not culpable.

"The minister, in approving work and entry permits, acted within the powers vested on him by the Immigration Act, which gives the minister discretion to grant or reject appeals," says the report.

However, the committee, chaired by Mt Elgon MP Fred Kapondi, faulted the Immigration Act, citing a lacuna on the maximum number of foreigners to be naturalised.
